1. Acceptance of Terms
By accessing and using fivebrothersdumpsters.com, you agree to be bound by these terms. If you do not agree, please do not use our site or services.
2. Accuracy of Information
We make every effort to ensure that pricing, dumpster availability, and service areas listed on the site are accurate. However, we reserve the right to correct any errors or update information at any time without prior notice.
3. Intellectual Property
All content on this website, including our logo, text, and photos, is the property of Five Brothers Dumpsters and is protected by copyright laws. You may not use our branding or content for commercial purposes without our written permission.
4. Third-Party Links
Our site may contain links to third-party websites (such as Google Maps). We are not responsible for the content or privacy practices of those external sites.
5. Limitation of Liability
To the maximum extent permitted by law, Five Brothers Dumpsters shall not be liable for any indirect, incidental, or consequential damages resulting from your use of this website or any technical issues that may arise while browsing.
6. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Tennessee.
Rental Agreement
1. Rental Fees and Payment Terms

Additional days: $50 per day beyond the agreed rental period. Days must be verified and agreed upon by Five Brothers Dumpsters.

Weight Limit: 2000 pounds/1 ton included in the rental fee. Anything over will be charged to customer.

Payment Term: Full payment is due upon execution of Agreement unless otherwise note in writing.

Additional fees (if applicable) will be invoiced and are due upon receipt.
2. Delivery and Placement
Five Brothers Dumpsters shall deliver the dumpster to the Customer’s address on the agreed upon delivery date. The Customer shall be responsible for obtaining any required permits for placement. The Customer shall ensure unobstructed access for delivery and pick-up. Failure to provide access may result in additional fees. Five Brothers Dumpsters shall not be liable for damage todriveways, lawns, or landscaping when following the Customer’s placement instructions.
3. Acceptable and Prohibited Materials

Acceptable Materials -Household waste, construction debris, yard waste, furniture, and appliances (excluding those containing refrigerants)

Prohibited Materials and Associated Fees - Disposal of prohibited items shall result in additional fees as determined by Five Brothers Dumpsters and may subject the Customer to legal action: - Tires, Batteries, Paints/Oils, Hazardous Chemicals, Asbestos, Medical Waste, Electronic Waste (TVs, computers, etc), Refrigerants, Propane Tanks, Explosive Materials, Dead Animals, Flammable Liquids
4. Loading the Dumpster.
The Customer shall not overload the dumpster or fill it beyond the designated fill line or over the top of dumpster. Overloaded dumpsters may result in additional fees and/or may not be hauled away. A trip fee of $100 may apply. The Customer shall be responsible for reloading an overfilled dumpster to comply with safety regulations.
5. Responsibility for Prohibited Material
The Customer shall bear sole responsibility for all costs, damages, and liabilities arising from the disposal of prohibited materials. Five Brothers Dumpsters reserves the right to return prohibited materials to the Customer or require proper disposal at the Customer’s expense.
6. Damage and Liability
The Customer shall be liable for any damage to the dumpster while on their property, except for normal wear and tear. Five Brothers Dumpsters shall not be liable for damage to property, including driveways and landscaping, during delivery or pick-up when following Customer instructions.
7. Indemnification
The Customer agrees to indemnify and hold harmless Five Brothers Dumpsters from any claims, damages, or liabilities arising from the Customer’s use of the dumpster.
8. Compliance with Laws
The Customer shall comply with all applicable local, state, and federal laws regarding waste disposal. The Customer shall be responsible for any penalties or legal fees arising from improper disposal practices.
9. Termination of Agreement.
Five Brothers Dumpsters reserves the right to terminate this Agreement if the Customer breaches any terms. No refunds shall be provided if the Agreement is terminated due to a Customer breach.
10. Excused Performance
Except for the payment of amounts owed hereunder, neither party hereto shall be liable for its failure to perform or for delay in its performance hereunder due to contingencies beyond its reasonable control including, but not limited to, strikes, riots, compliance with laws or governmental orders, inability to access a container, fires, inclement weather and acts of God, and such failure shall not constitute a breach under this Agreement. For the avoidance of doubt, however, a law or government order, ordinance or award establishing an exclusive franchise or similar right for a service provider in Contractor’s service area shall not excuse Customer’s performance hereunder.
11. Governing Law.
This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee.
12. Entire Agreement
This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements or discussions.
13. Amendments
Amendments to this Agreement shall be in writing and signed by both parties.
14. Attorney's Fees.
If Customer defaults or otherwise breaches this Agreement, Customer shall pay to the extent permitted by law, all of Five Brothers Dumpster’s reasonable attorney’s fees and costs Five Brothers Dumpsters incurs to enforce its rights against the Customer for cancellation of this Agreement.
